Terms and Conditions

A LEGAL DISCLAIMER

These Terms and Conditions govern your use of the Sud Hounds website and the provision of pressure washing and related exterior cleaning services by Sud Hounds ("we," "us," or "our"). By requesting an estimate, scheduling services, accessing our site, or engaging us for work, you agree to be bound by these Terms as well as by our Privacy Policy. If you are entering into an agreement on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
 

Sud Hounds provides exterior cleaning services, including pressure washing and associated treatments, as described in the work order, estimate, or invoice we provide. Service descriptions, project scope, timelines, pricing, and any special conditions will be set forth in our written estimate or job order. Estimates are provided based on the information available at the time of inspection or inquiry and are valid for the period stated on the estimate or, if none is stated, for thirty days from issuance. Because job-site conditions can change or hidden conditions may exist, additional charges may apply if unforeseen circumstances are discovered or if you request changes to the scope of work. Any change to the agreed scope that affects price or scheduling will be documented in a written change order and requires your approval before the additional work is performed.

To enable us to perform services, you must provide clear and safe access to the work area, remove breakable or valuable items from the vicinity of the work, and disclose any known defects, hazardous materials, or special conditions such as lead paint, asbestos, contaminated soil, buried utilities, oil stains, or chemical contamination. You are responsible for obtaining and paying for any permits or approvals required by local authorities prior to the commencement of work unless otherwise agreed in writing. You must advise us of any neighborhood, condominium, or municipal restrictions regarding water use, wastewater discharge, or noise. Sud Hounds will take commercially reasonable measures to comply with applicable environmental and disposal rules, but you remain responsible for any fines, penalties, or liabilities arising from your failure to obtain required permits or to comply with applicable laws.
 

We may require a deposit to secure an appointment or as otherwise stated in your estimate. Payment terms, accepted payment methods, and any required deposits or retainers will be provided in the estimate or invoice. Final payment is due upon completion of the work or as otherwise specified in the written agreement. If payment is not made when due, we may charge interest, suspend further services, or pursue collection remedies. Taxes and governmental fees are your responsibility and will be added to invoices where applicable. We process payments using third-party payment processors and do not store your full payment card details; however, professional payment processors may retain certain information in accordance with their policies and applicable law.
 

You may cancel or reschedule services by contacting us in advance. Cancellation and rescheduling policies, including any applicable cancellation fees, will be provided in your estimate or appointment confirmation. Sud Hounds reserves the right to reschedule or cancel services due to weather, safety concerns, equipment failure, supplier issues, or other events beyond our control, and we will use reasonable efforts to notify you promptly. If our personnel are delayed or prevented from performing services due to factors outside our control, additional charges for labor and rebooking may apply.
 

Unless otherwise agreed in writing, Sud Hounds warrants that services will be performed in a professional and workmanlike manner consistent with industry standards. You must submit any claim for property damage within 48 hours after job completion. Any claim regarding the quality or performance of our services must be submitted within 15 days of completion, describing the issue in detail and providing supporting images where possible. If we determine that the claim is valid, our obligation will be to correct the affected work or, at our discretion, issue a credit or refund limited to the amount charged for the specific services giving rise to the claim. Except as expressly set forth in this paragraph, we disclaim all other warranties, whether express or implied, including any implied warranties of merchantability and fitness for a particular purpose.
 

To the fullest extent permitted by law, Sud Hounds’ total liability for any claim, whether in contract, tort (including negligence), statute, or otherwise, arising out of or relating to the services or these Terms will not exceed the total amount paid to Sud Hounds for the specific services that gave rise to the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, lost business, loss of use, or diminution in property value. Some jurisdictions do not allow the exclusion or limitation of certain damages, and nothing in these Terms is intended to limit any rights you may have that cannot be lawfully limited.
 

You agree to indemnify, defend, and hold harmless Sud Hounds and its officers, owners, employees, contractors, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms, your negligence or willful misconduct, your failure to disclose relevant information, or your violation of any applicable law. Sud Hounds will promptly notify you of any claim subject to indemnification hereunder and will cooperate in the defense or settlement of the claim at your expense.
 

Sud Hounds maintains general liability insurance and any other insurance coverages we deem appropriate for our operations. Certificates of insurance may be provided upon request and subject to reasonable verification. While we maintain insurance, you are encouraged to carry appropriate homeowner, renter, or commercial insurance to protect your property and interests. Our possession of insurance does not relieve you of your obligations under these Terms.
 

We may take photographs or video recordings of the work site before, during, and after performance of services to document conditions and for marketing, promotional, or portfolio purposes. By engaging our services, you grant Sud Hounds a non-exclusive, royalty-free, transferable license to use such images and recordings for promotional purposes unless you give us written notice prior to commencement of work that you object to such use.
 

We may perform work using our own crews or subcontractors and will remain responsible for the performance of any subcontracted work as set forth in our agreements. All subcontractors and independent contractors retained to perform work will be selected based on their qualifications, and Sud Hounds will supervise the performance, but they are not employees of the customer.
 

These Terms may be terminated by either party for material breach if the breach is not cured within a reasonable period after written notice. Sud Hounds may refuse or suspend services at any time for nonpayment, safety concerns, or breach of these Terms. Upon termination, you remain responsible for payment for services performed up to the date of termination and for any reasonable costs associated with demobilization.
 

These Terms and any disputes arising under or related to them are governed by and construed in accordance with the laws of the State of Utah without regard to its conflicts of law principles. You agree that any litigation arising from these Terms will be brought exclusively in the state or federal courts located in Utah. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Failure by Sud Hounds to enforce any provision of these Terms will not constitute a waiver of our right to enforce that provision or any other provision in the future. These Terms, together with any written estimate, work order, invoice, and our Privacy Policy, constitute the entire agreement between you and Sud Hounds regarding the subject matter hereof and supersede all prior agreements and understandings, whether written or oral.
